Resumen

Desde la creación de la Corte Penal Internacional (CPI) como organismo internacional, su autonomía, competencia y procedimientos han incomodado a diversos Estados. Entre estos países destaca la confrontación permanente de los Estados Unidos que, prácticamente, han conformado una política institucional para oponerse a que ciudadanos norteamericanos sean juzgados ante este Tribunal. En este interés, han emprendido una serie de acciones para descalificar y minar su trabajo. Este artículo se enfoca en la participación de Estados Unidos en el proceso de negociación del Estatuto de Roma; en la serie de políticas que han emprendido con relación a la CPI, particularmente las derivadas de la situación en Afganistán que involucra, entre otros, a miembros de las fuerzas militares norteamericanas y de la Agencia Central de Inteligencia (CIA) de Estados Unidos. La administración Biden ha levantado las sanciones y ha testificado la invasión rusa a Ucrania, acontecimiento que ha evidenciado y reiterado la necesidad de contar con un Tribunal de las características de la CPI.
