Abstract

The initiative for constitutional reform presented by the President of the Republicfrom April 28, 2016, to provide to the Congress of the Union of the faculty to issue anational procedural code in civil and family matters, does not justify the reason whyaims to make this power of State legislatures assured the federation. Neither exposesfeatures of the procedural legislation that will be issued if approves this reform, anddoes not refer to the principles of orality, contradiction, immediacy, advertising andconcentration, that all civil process and since then family, required to be effectiveand modern, meaning a due process.
