Digital disconnection: Diagnosis and challenges for its regulation and implementation in the private sector

Abstract

The present article has for objetives: i) evaluate the scopes of the regulation of the right to digital disconnection and ii) analyze the implementation of institutional policies in the private sector regarding the right to digital disconnection. In this sense, the research is correlational explanatory and bibliographic review, obtaining that at the international level the employer has a guaranteeing role for workers’ rights. However, in Peru the guidelines for the implementation have not been established of politicies for the right to digital disconnection in private companies. For this reason, this research work will address the challenges for the implementation of the right to digital disconnection, within the framework of the right to rest from work and the health of workers.

Bachelor of Law from the Universidad Nacional Mayor de San Marcos, graduated from the Master's Degree in Labor and Social Security Law from the Graduate School of the same university, with Master's studies in Administrative Law and Public Management from the University Private San Juan Bautista. He has more than six years of experience in public entities in the Legal Area and the Technical Secretariat of Disciplinary Administrative Procedures
