Estoppel y la Convención de Nueva York. Contornos económicos de una aproximación hermenéutico-axiológica

Resumen

Este artículo propone como hipótesis de trabajo que ciertas interpretaciones del Artículo V-2b de la Convención de Nueva York comparadas con la dimensión conceptual del estoppel podría equivaler a una violación del ordenamiento internacional. El método utilizado es hermenéutico-analítico y se examinan diversos ejemplos en los que hay de por medio o tratados en vigor o declaraciones hechas por los Estados y cómo el principio de estoppel puede verse menoscabado. El artículo se divide en dos partes: la primera presenta algunas precisiones preliminares doctrinales y jurisprudenciales; la segunda, examina el problema de las declaraciones de los Estados y el estoppel a la luz de una pieza jurisprudencial de Colombia. Con base en los hallazgos resultantes de los análisis precitados se concluye que debe haber flexibilidad en las políticas comerciales y de inversión de los Estados, pero rigidezen la observancia de los principios y valores jurídicos.
